Terms of Use

The rules between you and Time Capsule: what we offer, what you choose, what you pay and what cannot be undone.

1. Who we are

Time Capsule (in Portuguese, Cápsula do Tempo) is a service provided by AMONG SOLUÇÕES EM SOFTWARES E TECNOLOGIA LTDA, Brazilian company registration (CNPJ) no. 58.088.554/0001-72, headquartered at Avenida Augusto Franco, 2960, Ponto Novo, Aracaju/SE, CEP 49097-670 (“we” or “us”).

2. Accepting these terms

These Terms of Use, the Privacy Policy and the “Keeping the key” page form the agreement between you and us. You accept them through an action of your own when you sign up — never through a box that comes already ticked. We record the date, the time and the version of the terms you accepted.

If you do not agree with these terms, do not use the service. The documents are published in Portuguese and in English; if the two versions differ in meaning, the Portuguese version prevails.

3. The service

With Time Capsule you create a capsule, invite other people to take part, write goals and letters, upload photos and videos, seal the capsule and open it on the opening date you chose. A capsule goes through three stages:

  • Open for writing: you and the participants write and upload content.
  • Sealed: the content is encrypted with the capsule’s key and kept until the opening date. Nobody writes, edits or reads during this period.
  • Opened: from the opening date, with the key, the content is available for the participants to read.

The features of each capsule — plan, time until opening, number of participants, media storage and add-ons — are those shown in the product at the time of purchase, and they are recorded in the capsule itself.

4. Your account

To use the service you create an account with your email; you sign in with a code sent to that email, with no password. You are responsible for keeping access to your email secure and for everything done in your account. If you notice access you do not recognize, let support know.

Children and teenagers

There is no minimum age to use Time Capsule. People under 18 (eighteen) years old use the service with the authorization and supervision of their father, mother or legal guardian. Data of children (under 12 (twelve) years old) is only processed with the specific consent of one of the parents or the legal guardian, as set out in article 14 of the Brazilian General Data Protection Law (LGPD).

Payments can only be made by people over 18 (eighteen) years old or by the minor’s legal guardian.

5. Plans, prices and payment

You buy per capsule, with a one-time payment: there is no subscription and no recurring charge. The price of each plan and each add-on (for example, photos and videos, extra storage, extra invitations or more time until opening) is the one shown on screen before payment, in the currency indicated, with the total itemized.

The price paid is recorded in the capsule and does not change afterwards. Future changes to the price list do not affect capsules already paid for.

Payments are processed by Stripe, by card or Pix. Card details are entered directly with Stripe: we do not receive or store the card number. The capsule is unlocked once payment is confirmed; a Pix payment not made within the time shown expires with no charge.

6. Right of withdrawal and refunds

Because the purchase is made online, you can withdraw from it within 7 (seven) days of purchase, without giving a reason, as guaranteed by article 49 of the Consumer Defense Code.

To withdraw, write to [email protected] from your account’s email, saying which capsule. We refund the full amount paid, through the same payment method used (a refund to the card or a Pix return). How long the amount takes to show up depends on your card issuer or your bank.

After the 7 (seven) days, there is no refund, except where the law requires one — for example, if the service is not provided as purchased.

7. Who sees the capsule’s content

A capsule is a shared space. The goals, letters and media sent by any participant are visible to all participants in that capsule, depending on the stage it is in:

  • Open for writing: the other participants’ content appears hidden behind a spoiler warning. Anyone who wants to can reveal it; anyone who prefers the surprise can wait for the opening.
  • Sealed: nobody sees the content — not the participants, not you.
  • Opened: everything is free to read by all participants.

There is no private content inside a capsule. Write knowing that the other people in the capsule will read it.

8. Invitations and participants

Whoever creates the capsule can invite people by email, within the plan’s participant limit. The invited person receives an email and, to take part, signs in with an account linked to the same invited address. Invitations are valid while the capsule is open for writing.

When you invite someone, you confirm that you have a relationship with that person that justifies the invitation and that they expect to receive it. Do not use invitations to send bulk or unsolicited messages.

9. Responsibility for content and prohibited content

You are responsible for what you write and upload, and you guarantee that you have the right to share that content with the capsule’s participants — including photos and videos in which other people appear. You may not use the service for:

  • illegal content, including any material depicting the sexual abuse or exploitation of children and teenagers;
  • threatening, harassing, discriminating against, defaming or exposing the intimate life of another person without their permission;
  • infringing copyright, image rights or other third-party rights;
  • sending malicious software, trying to access accounts or data that are not yours, or disrupting the operation of the service;
  • sending spam or using the service for purposes other than those it was made for.

10. Content removal and suspension

If we become aware of content or use that breaks the law or these terms, we may remove the content within our reach, suspend or close the account involved and, where the law requires, notify the authorities. To report a problem, write to [email protected].

The content of a sealed capsule is encrypted. When only you keep the key, we have no way to read or assess that content until the opening.

11. The capsule’s key

Each capsule has a key, shown only once at the moment of sealing and also sent to your email. When sealing, you choose who keeps that key:

  • We keep a copy (recoverable): we hold a protected copy of the key and, if you lose yours, we can send it again to you — or to the backup contact you name — for the opening.
  • Only you keep it (irreversible): we keep no copy. If the key is lost, the content can never be read again — by anyone, not by us, not by support, not through any administrative access.

Your choice is recorded along with the version of these terms. You can switch from “we keep a copy” to “only you keep it” later, but never the other way round. If you choose to keep the key on your own, keeping it safe is your responsibility: we are not liable for being unable to open the capsule because the key was lost, since, by your decision and by the system’s design, no recovery path exists. 12. Sealed capsules and deleting capsules

Once sealed, the capsule takes no new content and cannot be edited. It is kept until the opening date you chose.

When a capsule is deleted, we immediately erase the texts and the keys that give access to the content: from then on, it can no longer be read by anyone, not even us, and the deletion cannot be undone. The media files, which are already encrypted, are protected against deletion in storage until the scheduled opening date and are erased as soon as it arrives.

To ask for a capsule to be deleted, write to [email protected] from the email of the account that created it. Deleting a capsule does not entitle you to a refund outside the withdrawal period.

13. After the opening date

When the opening date arrives, we let you know by email and the capsule can be opened with the key. Once opened, whoever created it can download a copy of the content.

Opened or not, the capsule is kept for 24 (twenty-four) months from the opening date. At the end of that period, it is deleted from the service. If you want to keep the content for longer, download your copy before then.

14. Closing your account

You can ask for your account to be closed at any time, by emailing [email protected]. Closing it erases your account data and deletes the capsules you created, as described in the section “Sealed capsules and deleting capsules”.

If you created a capsule that has already been sealed or opened, the closure takes place 30 (thirty) days after the request, and the participants in those capsules are notified. If you sign in to your account during that period, the request is canceled. With no sealed or opened capsules, the closure is immediate.

What you wrote in someone else’s capsule is part of that capsule and stays in it. Closing your account does not open or rewrite other people’s capsules.

Even after closure, we keep only what the law requires or what serves as proof of the agreement: the record of your acceptance of these terms and of your key-keeping choices, and the payment records.

We may also close an account that breaches these terms seriously or repeatedly. Where possible, we let you know first and explain why.

15. Availability and liability

We work to keep the service available and the content safe, with encryption, backups and monitoring. Interruptions may happen because of maintenance, third-party failures or events beyond our control; when an interruption is planned, we will try to give notice in advance.

We are liable for the damage we cause in providing the service, under the Consumer Defense Code. We are not liable for damage caused solely by you or by third parties — for example, the loss of a key that only you kept, someone else accessing your email, or content written by other participants. Nothing in these terms takes away rights that the law guarantees to consumers.

16. If the service shuts down

If Time Capsule shuts down, we will give at least 90 (ninety) days’ notice and offer a full export of your content.

The notice will be sent to your account’s email. For capsules that are still sealed, the export will contain the encrypted content, which can only be opened with the key. That is why keeping it remains essential.

17. Intellectual property

The content you create remains yours. You authorize us to store it, encrypt it, copy it into backups and show it to the capsule’s participants, only as far as needed to provide the service. We do not use your content for advertising or to train systems.

The Time Capsule brand, name, look and software belong to us or are licensed to us, and these terms do not transfer any rights over them.

18. Communications

We talk to you through your account’s email: sign-in codes, invitations, payment confirmations, capsule reminders, the opening notice and notices about these terms. These messages are part of the service. We do not send marketing email without your consent.

19. Changes to these terms

We may update these terms to reflect changes in the service or in the law. Each version is dated and recorded in the history below. When a change is significant, we will let you know by email or in the product before it takes effect. The conditions of a capsule already paid for (price, time until opening and key-keeping choice) do not change because of a later change to these terms.

20. Governing law and jurisdiction

These terms are governed by the laws of the Federative Republic of Brazil, in particular the Consumer Defense Code, the Brazilian Internet Civil Framework (Marco Civil da Internet) and the General Data Protection Law.

If you are a consumer, any disputes may be brought in the courts of your place of residence (article 101, I, of the Consumer Defense Code). In all other cases, the courts of the district of Aracaju/SE are chosen.
